Studio Hire Terms and Conditions
 

 
1 Permitted Use
 

   1.1 The studio is designated solely for dance and related activities. Any misuse of the space will result in a charge at twice the commercial hire rate. Misuse would be deemed as anything that would not normally take place in a dance studio .  If you are unsure please contact bookings@theyardwakefield.co.uk

2  Private Hire Regulations
 

  2.1 Private hire is intended for individuals or small groups where no monetary gain is   derived by any users or individuals renting the studio. 

2.11 Private Hire by up to 3 users - for use for 3 or less dancers.  Parents, chaperones or teachers are not included in the users unless they are also dancing.

2.12 Private Hire for 4+ users - for use for 4 or more dancers.  Parents, chaperones or teachers are not included in the users unless they are also dancing. 

  2.2  If the studio is reserved for private hire but is discovered to be used for     commercial purposes, a fine will be imposed equal to twice the commercial hire rate.

2.21 The only exception to rule 2.2 is a private lesson held by a teacher with just one dancer.  To help support teachers and private lessons we will only charge the private hire rate for 1 to 1 private lessons.  The commercial hire rate must be used for more than one dancer in a paid for private lesson when anyone is making monetary gain from using the studio 

3.   Commercial Hire Regulations

3.1 Commercial hire is intended for any party that is using the hire of the studio for monetary gain, this includes (but is not a fully inclusive list) choreographers, teachers, dance schools or associates who are charging dancers to attend a class, semi private lesson or workshop 

3.11 Where a teacher/choreographer is running 1 to 1 private lessons they may use the private hire rate as per rule 2.21. However if there is more than 1 dancer attending the private lesson the commercial hire rate must be used.

 
4.  Rental Period

 

  4.1 The studio rental period commences at the start of the hired time and concludes at the end of the hired time. Users are responsible for adhering to the scheduled time; any overruns may incur additional charges

4.11 If a set up or dismantle time is required this must be done within the rental period. The hirer must vacate the studio at the end of their hire period.  Failure to do so could result in additional charges equal to the equivalent hire rate


 

 
5. Personal Liability Insurance
 

 5.1 All users of the studio are required to have their own personal liability insurance. The studio is not liable for any injuries sustained during activities conducted within the space.

5.2 Commercial users of the studio should have additional liability insurance to allow them to teach others in a public place 

5.3  The Yard is not responsible at any time for any user of the studio if they are under or over the age of 16.  Any person hiring or using the studio does so at their own risk.


 

6. Safeguarding 

 6.1 The Yard is non manned studio.  All users under the age of 16 should have an adult present for the full hire period.

6.11 If the user/s of the studio are aged under 16 and will not have adult supervision a waiver must be signed by an appropriate adult.  

 

6.2 The hirer accepts responsibility for themselves and anyone else who is using the studio during their hire period - The Yard is not responsible for what happens inside or outside of the studio space

 

 

 
7 Damage Responsibility

  7.1  Users are responsible for any damage caused to the studio or its equipment during their hire period. All damages must be compensated at the full cost of repairs or replacements.


 

 
8. CCTV Monitoring
 

 8.1 Purpose of CCTV Monitoring
The CCTV system is installed primarily for the safety and security of users, employees, and property. It aims to deter and prevent crime and provide evidence in the event of an incident.
8.2. Notification
Users will be notified of the presence of CCTV through clear signage displayed in the studio premises. The signage will indicate that CCTV is in operation and the purposes for which the footage may be used.
8.3 Data Protection Compliance
The studio will comply with relevant data protection laws, including the UK General Data Protection Regulation (GDPR) and the Data Protection Act 2018. Personal data captured through CCTV footage will be processed lawfully, fairly, and transparently.
8.4.Retention of Footage
CCTV footage will be retained for a limited period, typically no longer than 30 days, unless there is a legitimate reason to keep it longer (e.g., ongoing investigations or disputes). Once the retention period expires, the footage will be securely deleted.
8.5 Access to Footage
Access to recorded footage will be restricted to authorized personnel only. Users may request access to their images under the GDPR, but requests must be made in writing, specifying the reason for the request.
8.6 Confidentiality and Security
All CCTV footage will be stored securely to prevent unauthorized access or breaches. Any sharing of footage with third parties will only occur in compliance with relevant legal requirements, such as law enforcement requests.
8.7 User Rights
Users have the right to inquire about the use of CCTV in the studio, including how long footage is retained, who has access to it, and how it is secured. Users also have the right to raise concerns regarding the CCTV operation.
8.8 Compliance with Relevant Legislation
The studio will adhere to the Surveillance Camera Code of Practice and any other applicable regulations regarding the use of surveillance systems.
8.9 Liability Disclaimer
The studio does not accept liability for any issues arising from the CCTV monitoring system, provided that all measures to comply with legal requirements have been taken.


 

 

 
9. Cancellation Policy
 

 

   9.1  Cancellations made within 48 hours of the scheduled booking will not be eligible for a refund.

   9.2  Users may reschedule their booking up to 12 hours before the reserved time without any penalty.
 

 

10. Payment Terms

 

  10.1  Payment MUST be making within 48 hours of placing the booking, or in the case where the booking is made within 48 hours of the hire period, payment must be made straight away.  

10.11 Failure to make payment as per term 10.1 may result in the booking being cancelled.

  10.2. It is the hirers responsibility to ensure they have paid and the booking is confirmed.  If payment is not received and the hirer turns up at the studio access may be denied even if payment is offered at the time

By booking the studio, users acknowledge that they have read, understood, and agree to comply with these Terms and Conditions. Failure to adhere to any of the above stipulations may result in penalties or restrictions on future bookings.
